<br />corrections. All such corrections are subject to City Council <br />approval. <br /> <br />h. If an applicant questions the boundary of a wetland, the <br />jurisdictional status of a wetland, or whether a wetland exists, they <br />shall have the burden to supply detailed infonnation, for review by <br />the LGU, supporting the applicant's assertion, including but not <br />limited to, topographic, hydrologic, floristic and/or soil data <br />deemed necessary. <br /> <br />9.26.05 General Standards. The following standards apply to all lands within <br />and/or abutting a wetland: <br /> <br />Snbd. 1. Septic and Soil Absorption Systems. Septic and soil absorption <br />systems must be setback a minimum of seventy-five (75) feet from the City approved <br />boundary of the wetland. <br /> <br />Subd. 2. Best Management Practices., The MPCA's Best Management <br />Pr~ctices shall be followed for the construction of wetland protection methods and related <br />improvements. <br /> <br />9.26.06 <br /> <br />Wetland Buffer Strips - When Required. <br /> <br />Subd. 1. Wetland Buffer Strip. A wetland buffer strip shall be <br />maintained abutting all wetlands on new lots of record created after November 14,2005. <br />Lots of record in existence on November 14, 2005 are not subject to the buffer <br />requirements set forth in this Section; At the time a final plat is to be recorded, the <br />developer shall also record a notice of the wetland buffer requirement and prohibited <br />activities against the title to the lot with the office of the Anoka County Recorder. Before <br />the City issues a building pennit for a lot with a required wetland buffer, the developer <br />shall install the wetland buffer monumentation required under Section 9.26.08. <br /> <br />Subd. 2. Wetland Buffer Compliance. Subject properties must comply <br />with the wetland buffer section setbacks from all wetlands including those wetlands not <br />located or only partially located on the subject property. <br /> <br />Subd. 3. Adjacent Roadways. For roadways that must be aligned either <br />adjacent to or across wetlands and are subject to WCA replacement requirements, <br />additional wetland filling to create a buffer strip shall not be required. All other <br />roadways and trails shall meet the buffer standards established in this Section, <br /> <br />Subd. 4. Development Grading. For buffers being created during <br />development grading, if the slope subsequent to final grading is greater than twelve (12) <br />percent, then the maximum buffer width for the wetland type is applicable to the area <br />having such slopes. The use of a meandering buffer strip is encouraged to help maintain <br />a natural characteristic but average buffer widths must be adhered to.
