Voting No: None. <br /> <br />Case #3: Request for a Conditional Use Permit to Operate a Groundwater <br /> Pump-out and Treatment Facility; Case of Waste Management of <br /> Minnesota, Inc. <br /> <br />Merland Otto stated that Waste Management is requesting a conditional use permit for a <br />groundwater treatment facility. They are obligated to the State under the consent order to clean up <br />contaminated groundwater. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to add (Under Item #6) <br />e. Approximately 6,000 feet of 15 inch underground discharge pipe; and f. <br />Approximately 600 feet of 36" reinforced concrete pipe. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Bawden, <br />Hendriksen, LaDue, Terry and Thorud. Voting No: None. <br /> <br />Commissioner Deemer mentioned t'l~at #30 refers to Sunfish Lake and he is under the impression <br />that it has not been officially renmncd Sunfish Lake. It is officially named Grass Lake. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend #'s 36 through <br />43 to read in the affirmative. <br /> <br />Motion carried. Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by COmmissioner Bawden to recommend that <br />City Council adopt findings of fact, as amended, relating to Waste Management of Minnesota, <br />Inc.'s request for a conditional usc permit to operate a groundwater pump-out and treatment <br />system. <br /> <br />Motion carried. Voting No: None. <br /> <br />The Planning and Zoning Commission proceeded to review the proposed conditional use pmxnit. <br /> <br />With regard to #3: Commencemcnl 9f Work. Amend it to read "No operations shall commence <br />until all...". <br /> <br />With regard to #6: Charges and Fe~::.~, Amend it to read "WMMI shall reimburse the City for all <br />necessary and reasonable admin isl ratJ ye and consultant fees..." <br /> <br />With regard to #8: Bonding,. (About 3/4 of the way down the paragraph "... and the City is <br />required to expend monies of labor or material to supply sewer or water"... - strike "sewer or" so <br />it reads "to expend monies of labor or material to supply water.." <br /> <br />There was some discussion regarding #13 On-Site Inspection. It states that City Personnel or <br />agents performing the inspection will notify personnel at the landfill office at the time of inspection. <br />Mr. Otter requested a 24 hour prior notice.
