Mr. Wojcik asked why he wasn't told this use was prohibited.

Commissioner Hendriksen stated that staff has provided a definition of salvage. He stated that in
previous meetings, Mr. Wojcik denied what was going on at his operation and now he's admitting
to what's going on. He explained that at the last meeting this issue was presented very clearly to
Mr. Wojcik.

Commissioner Deemer stated if the State of Minnesota won't issue a license for a vehicle, it's not
allowed on Mr. Wojcik's property.

Mr. Wojcik argued that the State of Minnesota will issue license plates on the vehicles he has at his
place of business.

Commissioner Hendriksen stated that the State of Minnesota and the City Ordinance calls what Mr.
Wojcik is doing salvaging, and that is clearly prohibited in his conditional use permit.

Mr. Wojcik stated if the Commission is telling him he can't do what he's been doing, he'll cease
doing it.

Commissioner Hendriksen stated the Commission went through a lot of effort to draft this
conditional use permit and there are things going on that the Commission did not intend to take
place. He suggested that maybe City Council should revoke the present CUP and draft one that is
so detailed, it will leave no questions in Mr. Wojcik's mind what is or is not allowed.

COMMISSION INPUT

1) Conditional Use Permits

Chairman Zimmerman stated that with the "crunch" on the City's budget, one way to help would
be to have subcommittees of Commissions to check the status of compliance on conditional use
permits and report back to the Zoning Officer. This would reduce the chances of CUP's getting to
the point Mr. Wojcik's did.

Motion by Chairman Zimmerman and seconded by Commissioner Bawden to recommend that City
council approve of the Planning and Zoning Commission working with City Staff for Conditional
Use Permit compliance.

Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Bawden, Deemer,
Hendriksen and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud.

Planning & Zoning Commission/May 7, 1991
