The recording secretary was directed to correct this error. <br /> <br />Chairman Zimmerman agrees with Mayor Gilbertson's opinions on B-W zoning with regard to <br />Case #5 of the April 23, 1991 City Council minutes. <br /> <br />Referencing Case #2 in the May 28, 1991 City Council minutes, Chairman Zimmerman mentioned <br />that he would not want the taxpayers to get stuck with paying for street construction in Gateway <br />North Industrial Park. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: Request to Consider Amending Terms of Conditional Use Permit; <br /> Case of James Monson. <br /> <br />Zoning Administrator Frolik stated that it is Item #8 of the original conditional use permit that <br />would need to be amended. The area residents wish that the effort to construct the tree-screen of <br />the HAM radio tower be delayed until the tower has been fully erected so that a precise <br />determination of the tree placement can be judged and prescribed. Ms. Frolik mentioned that this <br />placement could be left to the discretion of the City Engineer. <br /> <br />Chairman Zimmerman asked Mr. Monson if that was an acceptable solution for him. <br /> <br />Mr. Monson stated that he was agreeable to this solution. Mr. Monson will provide the City <br />Engineer with a screening plan for approval when the HAM radio tower is complete. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to readopt Findings of <br />Fact #0289 relating to 15705 Traprock Street N.W., P.I.N. 16-32-25-43-0008. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Bawden, Deemer, LaDue, <br />Terry and Thorud. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Terry and seconded by Commissioner Bawden to amend the terms of the <br />conditional use permit issued to James Monson for an Amateur Radio Tower at 15705 Traprock <br />Street N.W., P.I.N. 16-32-25-43-0008 so that Item #8 will read: That the permittee shall plant <br />coniferous trees ranging in height from 20 - 30 feet on the subject property to provide screening, <br />subject to approval of the City Engineer. <br /> <br />Amendment by Commissioner Terry and seconded by Commissioner Bawden to include the <br />conditions that the said plantings shall be accomplished by June 1, 1992 and any trees not <br />surviving the winter shall be replaced by June 30, 1993. <br /> <br />Amendment carried. Voting Yes: Chairman Zimmerman, Commissioners Bawden, Deemer, <br />LaDue, Terry and Thomd. Voting No: None.
