Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council adopt Resolution #91-10-XX declaring Findings of Fact #XX, as amended, relating to <br />Northern Counties Secretarial Services request for a conditional use permit to establish <br />professional offices and daycare facilities in the R-1 Rural Residential District. <br /> <br />The Planning and Zoning Commission proceeded to review the proposed conditional use permit. <br /> <br />Acting Chairman Hendriksen asked Mr. Dennis Zylla if he had a chance to review the conditions to <br />which Mr. Zylla replied he had and that he had no problems with the conditions. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to add a condition stating <br />"No structures will be erected within 120 feet of the north or east property line. This is not <br />intended to preclude orderly subdivision and development of property as illustrated in Exhibit A". <br /> <br />Motion carried. Voting Yes: <br />Thorud. Voting No: None. <br />LaDue. <br /> <br />Acting Chairman Hendriksen, Commissioners Deemer, Terry and <br />Absent: Chairman Zimmerman, Commissioners Bawden and <br /> <br />Motion by Acting Chairman Hendriksen and seconded by Commissioner Deemer to add a <br />condition stating "Location of the play area and screening to mitigate noise will be incorporated in <br />the site plan review for any expansion". <br /> <br />Further discussion: Acting Chairman Hendriksen asked Mr. Abbendroth (adjacent property <br />owner) if he is in agreement with this added statement. Roslyn Kieke stated that playground <br />activity will be very structured and controlled; there may 20 children at a time for 20 minutes at a <br />time and these will be preschool aged children. Mr. Abbendroth felt the playground area should be <br />moved toward the parking lot. Ms. Kieke stated that the playground should be contiguous to the <br />area the daycare occupies. <br /> <br />Motion carried. Voting Yes: <br />Thorud. Voting Yes: Commissioners Deemer, Terry and Thorud. Voting No: Acting <br />Chairman Hendriksen because he doesn't feel #6 is necessary. Absent: Chairman Zimmerman, <br />Commissioners Bawden and LaDue. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council approve the request for a conditional use permit, as amended and adopt Resolution #91- <br />10-XX declaring conditions of the permit. <br /> <br />Motion carried.
