Goodrich, City Attorney <br />Adult Uses - Accessory in Relation =o Retail Business <br />December 3, 1991 <br /> <br />The issue of permitted Adult Uses - Accessory has risen in <br />conjunction with the proposed rezoning to the RB-Rural Business <br />District. The RB District does not allow Adult Uses - Accessory <br />as a permitted use. Adult Uses - Accessory are defined in the CiTy <br />Code as: <br /> <br />A use, business, or establishment having 10% or less of <br />its s~ock in trade or floor area allocated %o, or 20% or <br />less of its gross receipts derived from movie rentals or <br />magazine sales. <br /> <br />The movies or magazines referenced would be those where there is <br />an "emphasis on the presentation, display, depiction or description <br />of 'specified sexual activities' or 'specified anatomical areas' <br />which are capable of being seen by members of ~he public." <br /> <br />Therefore this definition applies to the sale of adult magazines <br />such as Playboy and Penthouse and the rental of X-rated movies by <br />convenience stores and video rental businesses. <br /> <br />The present zoning code permits Adult Uses - Accessory use in the <br />B-1 Business District. In review of the Zoning Code, the history <br />of the enactment of the Adult Use sections to the Zoning Code, and <br />in speaking with the City Planner who drafted the Adult Use <br />sections, I have concluded that Adult Uses - Accessory should be <br />a permitted use in any district which permits retail business. It <br />is my opinion that you should therefore review the MR Multiple <br />Residential, B-2 Business, RB Rural Business, I Industrial, and R- <br />I Rural Industrial Districts and consider adding Adult Uses - <br />Accessory as a permit=ed use. <br /> <br /> <br />
