Councilmember <br /> <br />introduc~,.d the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO MICHAEL ST. HILAIRE TO EXCEED. THE SIZE RESTRICTIONS FOR A <br />DETACHED ACCESSORY BUILDING ON PROPERTY FROM 1-1.9 ACRES AND <br />DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Michael St. Hilaire (Permittee) has-.properly applied for a conditional use <br />permit to exceed detached accessory building size restrictions for properties from 1-1.9 acres <br />established in section 9.11.02 :'Accessory Uses" of City Code on the property generally known as <br />4740 154th Lane and legally described as follows: <br /> <br />Lot 3, Block 1, Petersons Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on August 7, 2003, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a Conditional Use Permit (Permit) to exceed detached <br />accessory building height restrictions for properties from 1-1.9 acres as established in City <br />Code, is hereby granted to Michael St. Hilaire, hereinafter referred to as the "Permit-tee". <br /> <br />That the detached accessory building may exceed the 1,664~square-foot detached accessory <br />building size restriction for properties from 1-1.9 acres by a total of 352 square feet in order <br />to store vehicles and other personal property. <br /> <br />3. That the detached accessory building constructed on the property will comply with the <br /> permitted accessory structure height restrictions established in City Code. <br /> <br />That the construction of the detached accessory building on the Subject Property shall require <br />issuance of a building permit from the City of Ramsey and the Permittee is allowed to use <br />vinyl or hardboard siding as. exterior material for the building. <br /> <br />5. That the accessory building shall be properly constructed and maintained in accordance with <br /> all applicable Uniform Building Codes. <br /> <br />6. The Permittee herein agrees that no business or residential use will be operated in the <br /> detached accessory building unless such use is permitted in accordance with the City Code. <br /> <br />35 <br /> <br /> <br />
