Board Member introduced~ the following resolution and moved for its adoption: RESOLUTION #03-08- A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ROBERT AND MARTINA WALLACE AT 5941 143tm CIRCLE NW (PERMITTEES) FOR ACCESSORY STRUCTURE HEIGHT RESTRICTIONS AND DECLARING TERMS OF SAME , WHEREAS, Robert and Martina Wallace (Permittees) have properly applied for a variance from Section 9.11.02 of the Ramsey City Code for the height of an accessory structure on the property generally known as 5941 143~d Circle NW and legally described as follows: Lot 10, Block 1, Chestnut Hill, Anoka County, Minnesota (Subject Property). AND WHEREAS, the Board of Adjustment conducted a public hearing on August 7, 2003, pursuant to Section 9.03.05 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF ~HNNESOTA, as follows: 1. That based on Findings of Fact #__ a variance to the height restriction of an accessory structure on the Subject Property is heret~y granted. 2. That the accessory structure constructed on the Subject Property Shall maintain a maximum height, as measured at the mean gable height of the roof, of sixteen and a half (16.5) feet. 3. That no other structure or addition shall be constructed unless it is in accordance with City Code. 4. That the Permit-tees shall be responsible for all costs incurred in administering and enforcing this variance. 5. That the Permittee shall obtain all necessary permits prior to commencing any construction of. the accessory structure. That the accessory structure shall be used for storage of personal property and that no commercial activity of any type shall be permitted in said structure unless it is in accordance with City Code. That the Permittee agrees that the terms of this Variance shall be binding upon its successors and assigns. 13
