Board Member <br /> <br />introduced~ the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO ROBERT AND <br />MARTINA WALLACE AT 5941 143tm CIRCLE NW (PERMITTEES) FOR <br />ACCESSORY STRUCTURE HEIGHT RESTRICTIONS AND DECLARING TERMS OF <br />SAME , <br /> <br /> WHEREAS, Robert and Martina Wallace (Permittees) have properly applied for a <br />variance from Section 9.11.02 of the Ramsey City Code for the height of an accessory structure <br />on the property generally known as 5941 143~d Circle NW and legally described as follows: <br /> <br />Lot 10, Block 1, Chestnut Hill, Anoka County, Minnesota <br />(Subject Property). <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on August 7, <br />2003, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF ~HNNESOTA, as follows: <br /> <br />1. That based on Findings of Fact #__ a variance to the height restriction of an accessory <br /> structure on the Subject Property is heret~y granted. <br /> <br />2. That the accessory structure constructed on the Subject Property Shall maintain a maximum <br /> height, as measured at the mean gable height of the roof, of sixteen and a half (16.5) feet. <br /> <br />3. That no other structure or addition shall be constructed unless it is in accordance with City <br /> Code. <br /> <br />4. That the Permit-tees shall be responsible for all costs incurred in administering and enforcing <br /> this variance. <br /> <br />5. That the Permittee shall obtain all necessary permits prior to commencing any construction of. <br /> the accessory structure. <br /> <br />That the accessory structure shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure unless it is in accordance <br />with City Code. <br /> <br />That the Permittee agrees that the terms of this Variance shall be binding upon its successors <br />and assigns. <br /> <br />13 <br /> <br /> <br />
