11. That in 2002, the City Code was amended to increase the setbacks on a comer lot to thirty <br /> (30) feet. <br /> <br />12. <br /> <br />That the Applicants have stated that the detached accessory building will not have a paved <br />access to Potassium St NW as City Code currently restricts parcels in the 2020 MUSA to one <br />(1) driveway and the Subject Property has an existing access on 143rd Circle. <br /> <br />13. <br /> <br />That in accordance with City Code, the proposed building will be constructed of materials <br />similar to that of the home including maintenance free vinyl siding and shingles matching <br />those of the home. <br /> <br />14. That there is sufficient area on the Subject Property to construct the accessory structure in <br /> accordance with the current side yard setback for comer lots. <br /> <br />15. That the variance requested is/is not the minimum variance which would alleviate the <br /> hardship in regard to the side yard setback requirement. <br /> <br />16. That if granted, the variance will/will not impair an adequate supply of light and air to <br /> adjacent property. <br /> <br />17. That if granted, the variance will/will not have the effect of allowing a use that is prohibited <br /> in the applicable zoning district. <br /> <br />18. That if granted, the variance will/will not impair established property values within the <br /> neighborhood. <br /> <br />19. That the increased height will/will not be compatible with the principal building on the same <br /> parcel. <br /> <br />20. That the increased height will/will not be compatible with existing development in the <br /> immediate neighborhood. <br /> <br />21. That if granted, the variance will/will not unreasonably increase the congestion in the public <br /> street. <br /> <br />22. That if granted, the variance will/will not increase the danger of fire or endanger the public <br /> safety. <br /> <br />23. That if granted, the variance will/will not violate the intent of the Comprehensive Plan. <br /> <br />24. That, if granted, the variance will/will not grant the Applicant any special privileges that are <br /> denied to other owners of.land in the same district. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />~8 <br /> <br />and the following voted against the same: <br /> <br /> RESOLUTION #03-08- <br /> Page 2 of 3 <br /> <br /> <br />
