CASE # <br /> <br /> PUBLIC HEARING' <br />REQUEST FOR A VARIANCE FOR THE HEIGHT OF AN ACCESSORY STRUCTURE <br />AND TO THE SIDE YARD SETBACK; <br /> CASE OF ROBERT AND MARTINA WALLACE <br /> By: Chris Anderson, 'Community Development Assistant <br /> <br />Background: <br /> <br />Sections 9,11.02 and 9.20.11 of the Ramsey City Code regxtlate the height of accesso.ry structures <br />and the setbacks for accessory structures, respectively. On parcels less than two and a half (2.5) <br />acres in size, accessory structures are limited to a maximum height of sixteen (16) feet, as <br />measured at the mean gable roof height. Also, for properties located within the 2020 MUSA that <br />are comer lots, the side yard setback is thirty (30) feet. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Site picture <br />d) Letter from the Applicants <br />e) Site plan cross section <br />f) Proposed Findings of Fact to exceed maximum height <br />g) Proposed resolution to approve variance for accessory structure height restrictions <br />h) Proposed Findings of Fact to encroach into the required side yard setback <br />i) Proposed resolution to deny variance for side yard setback requirements <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations:' <br /> <br />City Code requires a thirty (30) foot side yard setback on comer lots for both principal and <br />accessory structures. When the Applicants' home was constructed, the side yard setback for <br />comer lots was twenty (20) feet. The Applicants are proposing to construct an accessory <br />structure in such a manner as to maintain the same side yard setback as their home as well as the <br />home on the adjoining property to the north (also a comer lot). <br /> <br />The Applicants are also proposing to construct the accessory structure at a height of sixteen and a <br />half (16.5) feet, measured at the mean gable height of the roof. ' For lots that are less than two <br />and a half (2.5) acres in size, City Code restricts the height of accessory structures, measured at <br />the mean gable height of the roof, to sixteen (1.6) feet. The Applicants wish to utilize the <br />accessory structure for indoor storage of private use vehicles and equipment. <br /> <br /> <br />
