MINNESOTA MISCELLANEOUS ACTS <br /> <br />unlawful act, or if {c) the registered owner furnishes to law enforcement <br />officers upon request the identity of the person in actual physical <br />control of the snowmobile at the time of such violation. The provisions <br />of this subdivision do not apply to any person who rents or leases a <br />snowmobile if such person keeps a record of the name and address of the <br />person or persons renting or leasing such snowmobile, the registration <br />number thereof, the departure date and time, and expected time of <br />return thereof. Such record shall be preserved for at least six months <br />and shall be prima facie evidence that the person named therein was the <br />operator thereof at the time it was operated contrary to. sections 84.81 <br />to 84.88, 100.26, subdivision 1, or 100.29. subdivisions 28 or 29. The <br />provisions of this subdivision do not prohibit or limit the prosecution of <br />a snowmobile operator for violating any of the sections referred to in <br />this subdivision~ <br /> <br /> 84.89 CONFISCATION OF SNOWMOBILE USED IN <br />BURGLARY. A law enforcement officer shah seize any snowmobile, as <br />defined in Section 84.81, used for the purpose of gaining access to <br />property for the purpose of committing the crime of burglary, as defined <br />in section 609.58. Any snowmobile seized pursuant to this section shall <br />be held, subject to the order of the district court of the county in which <br />the burglary was committed, and shall he confiscated after conviction of <br />the person from whom the snowmobile was seized and disposed of in <br />accordance with the procedure provided for equipment used in com- <br />mitting game and fish violations by section 97.50, subdivision 6, except <br />that the balance of the proceeds from the sale of a confiscated <br />snowmobile which are paid into the state treasury shall be credited to <br />the general fund. <br /> <br /> 84.90 LIMITATIONS ON THE OPERATION OF <br />RECREATIONAL MOTOR VEHICLES. Subdivision 1. For the <br />purposes of this section the following terms have the meanings given <br />them: (a) "Recreational motor vehicle" means any self-propelled vehicle <br />and any vehicle propelled or drawn by a self-propelled vehicle used for <br />recreational purposes including but not limited to snowmobile, trail bike <br />or other aH-terrain vehicle, hovercraft, or motor vehicle licensed for <br />highway operation which is being used for off-road recreational pur- <br />poses. {b) "Snowmobile" has the same meaning given by section 84.81, <br />subdivision 3. <br /> Subd. 2. Within the seven county metropolitan area, no person <br />shall enter and operate a recreational motor vehicle on lands not his <br />own, except where otherwise allowed by ]aw, without the written or oral <br />permission of the owner, occupant, or lessee of such lands. Written <br />permission may be given by a posted notice of any kind or description <br />that the owner, occupant, or lesee prefers, so long as it specifies the kind <br />of vehicles allowed, such as by saying "Recreational Vehicles Allowed", <br />"Snowmobiles Allowed", "Trail Bikes Allowed", "AH-Terrain Vehicles <br />Allowed", or words substantially similar. <br /> Subd. 3. Outside the seven county metropolitan area, no person <br />shah enter on any land not his own for the purpose of operating a <br />recreational motor vehicle after being notified, either orally or by <br /> 154 <br /> <br /> <br />
