Ms. Moreland indicated her client would waive the 60 day requirement. <br /> <br />Chairperson Nixt requested the issue be put on the September Planning Commission meeting <br />agenda. <br /> <br />Associate Planner Wald asked that the Commissioners let her know what they like or do not like <br />with the current Home Occupation Ordinance proposal, since Staff needs guidance. <br /> <br />Commissioner Brauer agreed this would be a good idea. He indicated he likes the chart on page <br />six of their packet showing the differences. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Johnson, Reeves, <br />Shepherd, Van Scoy and Watson. Voting No: None. Absent: None. <br /> <br />Case #3 <br /> <br />Public Hearing for Proposed Tree Preservation Ordinance <br /> <br />Presentation <br /> <br />Associate Planner Wald advised that the EPTF held a joint meeting with the Park and Recreation <br />Commission and the Planning Commission on March 20, 2003 to review the preliminary draft <br />ordinance. The final draft is enclosed for your review and information. She stated the ordinance <br />establishes some minimum performance standards as far as tree preservation and replacement for <br />new development. It also includes some enforcement tools to address diseased and/or hazardous <br />trees on private property. <br /> <br />Associate Planner Wald explained that in the subdivision code, more detail is needed, and <br />Section 5.14 needs to be updated to correlate with this ordinance. She indicated a number of the <br />EPTF members are here to answer any questions. <br /> <br />Chairperson Nixt opened the public hearing at 8:10 p.m. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt indicated they have density transitioning requirements and tree preservation <br />requirements, and he has heard the two are not compatible. He asked if the Commission were to <br />approve this tonight if those issues have been taken into consideration. <br /> <br />Associate Planner Wald stated Staff is fully aware they would need to go back to RI, R2 and R3 <br />Districts and Density Transition Ordinance to adjust the equation for how many trees are needed <br />on the property. <br /> <br />Chairperson Nixt indicated tree quality versus quantity has been discussed, and asked if Staff has <br />the forestry skills needed to enforce those requirements. <br /> <br />Planning Commission/July 10, 2003 <br /> Page 7 of 21 <br /> <br /> <br />
