Community Development Director Miller stated that it would be approved by staff and would not
go to the Council for approval, but they would be aware ofthem from the Weekly Update.

Associate Planner Gladhill stated that this is similar to the Home Occupation Ordinance, which is
now handled completely administratively. He stated that he would like the motion to include
language that wouldn't allow people to come back year after year and expand 19% of their square
footage.

Commissioner Brauer stated that there isn't anything in the language about whether it meets
existing setback requirements.

Associate Planner Gladhill stated that staff would review this as a site plan so all the current
requirements, setbacks, and architectural standards would still apply. He noted that there won't
be any variances approved administratively.

Commissioner Brauer stated that he would like to see a report given at each monthly meeting.

Commissioner Cleveland stated that somewhere in the document, it stated that the fees will be at
the discretion of the staff, and asked what those would be.

Associate Planner Gladhill stated that the intent is to collect the same fee for any site plan, which
is currently a $200 fee and $800 escrow. He stated that they are anticipating that part of the
escrow funds will be refunded to the applicant with this new process. He stated that any
additional fees incurred, will be charged to the applicant, as they are now.

Commissioner Brauer stated that he doesn't see any language about Town Center being exempt
and wonders if that should be included.

Associate Planner Gladhill agreed that this should be included in the language.

Commissioner Nixt asked if the Commission was comfortable allowing staff to make decisions
on 43,560 sq. ft. buildings.

Associate Planner Gladhill stated that 43,560 sq. ft. is the disturbed area and the building
wouldn't actually be that large.

Community Development Director Miller noted that the size could be limited further, if they
aren't comfortable with the size.

Commissioner Nixt asked about the reporting process from staff.

Associate Planner stated that it will be included in the staff update and also reported to the
Council through the Weekly Update or even possibly on the Consent Agenda, so it becomes
official record.

Planning Commission/March 5, 2009
