INTRODUCTION On May 27, 2008 a petition was received by City Council requesting the bituminous paving of Ute Street from 179 Lane to a distance approximately 800 feet to the north (terminating at the dead end turn around). A copy of this petition is contained in Appendix A. City council directed the preparation of this feasibility study in response to this petition. A draft feasibility study was prepared and discussed with the residents at an informational meeting held on September 10, 2008 and again with the Public Works Committee on September) 6, 2008. On January 24, 2009 a meeting with residents was held to discuss issues of concern contained in the initial feasibility study. Results of this meeting were presented to the Public Works Committee on February 17, 2009 which then recommended modifications in this study which were ratified by the City Council on March 10, 2009. The project area and benefitted properties is illustrated in Figure 1. This report will identify the existing street condition along with the proposed improvements and the associated costs and financing, including the cost to each benefitted property. Finally this report will provide a possible project timeline. EXISTING CONDITIONS The surface of the existing roadway is primarily native sand material with some aggregates that have been added to portions of the roadway. The roadway width is 16 to 18 feet wide. The street terminates in a dead end approximately 800 feet north of 179 Lane (CR27) with an irregularly shaped bulb which is roughly 35 to 40 feet at its widest dimension. This bulb functions very poorly as a turn around for large emergency vehicles and city plows and is even problematic for passenger vehicles to turn around without entering a private driveway. The project area is not platted and there had been uncertainty over the legal right of way available. The City has had ownership and encumbrance reports prepared for all eleven properties involved. It has been determined that the City has no rights other than prescriptive rights to the right of way it has been maintaining. This is roughly a 16 to 18 feet roadway width which meanders a distance of approximately four feet along the roadway from south to north. The City has also been maintaining an irregularly shaped turn around bulb at the north end of the street. The northern 200 feet of the roadway drains northward into the City ofNowthen. The southern 650 feet of the roadway drains easterly onto the adjoining property and toward Rogers Lake. Because of the relatively steep grade toward the lake, there is little ponding except for the area at the south end of the project area. There are few driveway culverts. A total of 11 properties have frontage along Ute Street. Three of these properties have double frontage with Waco Street to the west.
