There will be an outdoor play area located on the south side of the building. The play area will be beyond the paved fire lane behind the building. Per state code requirements, the outdoor area must be a minimum of 1,500 square feet. There appears to be more than sufficient green space to accommodate the outdoor play area. The applicant does intend to fence in the play area this spring /summer. The subject property is zoned B -1 Business District and daycare centers are listed as a conditional use in this district. There are a total of 137 parking stalls on the property (this includes 8 handicap stalls). While there are no specific parking requirements in City Code for daycare centers, there appears to be ample parking for this use (more so than its current location). The request was forwarded to MnDOT for comment due the site's proximity to TH47. MnDOT responded with no concerns regarding the request. • The Planning Commission conducted a public hearing on April 2 regarding this request. There were no verbal or written comments submitted at the hearing. —176— Recommendation: The Planning Commission recommended approving the Conditional Use Permit with a slight modification. The Planning Commission recommended that a condition of the permit be that the fire detection and alarm system, as well as the fence for the outdoor play area, be installed prior to opening for business. Staff revised the Conditional Use Permit accordingly. Funding: All costs associated with processing the application are the responsibility of the applicant. Council Action: Motion to adopt Resolution # for a conditional use permit; adopting Findings of Fact relating to the applicant's request -and - Motion to adopt Resolution # approving the applicant's request for a conditional use permit to operate a daycare center in the B-1 Business District based on findings of fact. -Or- Motion to deny the applicant's request for a conditional use permit based on the findings of fact.
