-188— <br />Attachment H <br />Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #09 -04 <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL OPERATION L USE OA <br />TO LIGHTHOUSE LEARNING CENTER, LLC ALLOWING THE <br />DAYCARE FACILITY ON THE PROPERTY LOCATED AT 5900 167 AVENUE NW, <br />BASED ON FINDINGS OF FACT # ; AND DECLARING THE TERMS OF SAME. <br />WHEREAS, Lighthouse Learning Center, LLC, hereinafter referred to as "Permittee ", <br />properly applied to the City of Ramsey (the "City ") for a Conditional Use Permit ( the "Permit ") <br />to operate a daycare facility on the on the property generally known as 5900 167 Ave NW and <br />legally described as follows: <br />The north 426.29 feet, as measured along west line, of that part of Southwest Quarter <br />of Southeast Quarter of Section 11, Township 32, Range 25 lying <br />of record, of center <br />line of Trunk Highway No. 47, except road, subject to easement <br />County, Minnesota <br />(the "Subject Property") <br />WHEREAS, the Planning Commission met on April 2, 20009onduc conducted <br />that publi Council hearing <br />pursant to Section 9.03.05 of the Ramsey City Code and recommended <br />approve the request for a Conditional Use Permit. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />This Permit is issued pursuant to Section 9.03.05 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br />1) That the Permittee shall be allowed to operate a daycare facility in the S Property, erty, as <br />shown on the site plan dated March 2, 2009 prepared by Phillip D. <br />as Exhibit A, effective upon the date of City Council approval. <br />2) That the Permittee shall adhere to all applicable State Building and State Fire Codes <br />regarding the operation of a daycare facility. <br />3) That the Permittee shall adhere to all State Daycare Licensing Requirements. <br />4) That the Permittee shall install or have installed both a fire detection and alarm system in the <br />unit and a fence for the outdoor play area prior to opening for business. <br />5) That the Permittee shall be responsible for obtaining all necessary permits prior to fence <br />installation or building modifications. <br />6) That this Permit shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br />7) That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br />
