Recommendation: After much discussion, the Planning Commission recommended that the City Council not repeal the Wetland Protection Ordinance. However, The Planning Commission did recommend that City Council initiate a collaborative process involving citizens of the community and board and commission members as the Council deemed appropriate, to reexamine the ordinance and look for opportunities to modify the ordinance in such a way that it doesn't fail in its essential purpose yet enhances flexibility to land owners and the City to use the Wetland Protection Ordinance as a land management tool. It is important to note that should the Wetland Protection Ordinance be repealed, any future development proposal would still be subject, to the Wetland Conservation Act rules and, if the disturbed area of a development is greater than one (1) acre, it would also still be subject to review by the Lower Rum River Water Management Organization. Funding Source: The costs associated with drafting and implementing ordinances and amendments are covered under existing City personnel. Council Action: Based on discussion; however, should the City Council choose to move forward and repeal City Code Section 9.26 (Wetland Protection), the motion should be to introduce Ordinance #09 -__ repealing Section 9.26 "Wetland Protection" of Chapter 9 of City Code.
