In each such case,the cauncil shall, by resalutian, <br />declare the vacancy to. exist ~d such vacancy shall be filled ~ccarding to. the pro.visio.ns af <br />Sectian 4.5. . . . . <br /> <br />4.5.5 When a vacancy in an elected affice af the city accurs within 120 days priar to. a <br />regular municipal electian date, the special 'electian to. fill the vacancy shall caincide with the <br />regular electian. If the vacancy occurs within sixty days prio.r to. the regular electian. date, the <br />notice of such vacancy' shall be published as soon as is practicable. If, within the 120 day periad <br />befare a regular municipal electian, the vacancy accurs in the office of the mayor or in the office <br />af any cauncilmember whose seats is to. be decided in the electian, said vacancy shall be <br />cansidered no.t to exist farthe purpo.ses afthe electio.n. Hawever, if such vacancy accurs in the <br />affice af either 'af the ather two. cauncilmembers, the seat shall be .filled by the candidate .fot <br />. cauncilinember with the third highest vote tatal, ar in the case af two. vacancies, the third and <br />faurth highest vate totals at the upcoming electian.
