<br />City Attorney Goodrich explained that in Section 4.5.5.2 he moved the phrase "if so <br />approved by unanimous vote of the sitting Council" to avoid any confusion. <br /> <br />There was consensus that this revision' to Section 4.5.5.2 was reasonable. <br /> <br />Commissioner Deemer stated the last sentence in Section 4.5.5.3 needs to have the word <br />"year" after the word "four" to clarify the reference to a four-year term. He stated this <br />provision should clarify that the commencement of the four-year term does not shift as a <br />result of the vacancy; in other words, the four-year term that this person is taking, does <br />not start over just because this person is filling a vacated terni. <br /> <br />City Attorney Goodrich stated the teim of this office is intended to expire on the same <br />date as the original term and this person is not getting a new four-year term; rather, this <br />person is filling the statutory. tenn of someone who resigned or otherwise vacated the <br />seat. <br /> <br />. Chairperson LaMere read a portion of SectioI]. 4.5.1, which states: "for the remainder of <br />the unexpired tenn of the office vacated.", She asked if this Section should be referenced <br />in Section 4.5.5.3 or if the actual wording should be included. <br /> <br />City Attorney Goodrich suggested adding: '1he, term of the office pursuant to this <br />subsection shall serve for the remainder of the unexpired term of the office vacated," as <br />stated in Section 4.5.1. ' <br /> <br />There was consensus to include this language in the proposed ordinance and forward it to <br />the City Council. <br /> <br />City Attorney Goodrich explained the Council procedure would be to hold a public <br />hearing on the, amendments to the Charter and the Council must pass the amendments by <br />unanimous action; if it does, the revisions are effective 90 days from the date when, <br />published. He stated if the amendments are not unanimously approved, there is a <br />statutory process for getting the amendments placed on the ballot, and these amendments <br />would have to be on the ballot twelve weeks ahead of the election. He added there would <br />be an election in November where the make-up of the Council will change; the Charter ' <br />Commission could also wait until January to present any Charter amendments to the <br />Council. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Frederick to approve <br />the amendments to Sections 4.5.5.2 and 4.5.5.3. <br /> <br />Chairperson LaMere clarified that the last sentence of Section 4.5.5.3 shall be deleted and <br />replaced with the language stating that the term of the office pursuant to this subsection <br />shall serve for the remainder of the unexpired term of the office vacated. <br /> <br />Charter Commission/June 12, 2008 <br />Page 4 of5 <br /> <br />-4- <br />
