<br />CASE # J <br /> <br />CONSIDER COMMENTS RECEIVED AT PUBLIC HEARING FOR <br />2009 STREET MAINTENANCE PROGRAM <br />By: Steven Jankowski, City Engineer <br /> <br />Background: <br /> <br />On February 17,2009 a public hearing was held on the 2009 'Street Maintenance program. <br />Property owners appeared and expressed concerns relating to two bituminous overlay projects; <br />IP 09"- 11, a bituminous ove;;lay of a portion of Barthel's Rum River Acres 2nd Addition; and, 09- <br />12 a bituminous overlay of the Hunters Hills Subdivision. The locations of these projects are <br />. illustrated on the figures attached to this case. Staff attempted to contact both property owners by <br />phone but also sent each the attached letter encouraging a meeting with them to review their <br />concerns. <br /> <br />A meeting was arranged with Mr. David Rauen, a property owner in the Barthel's Rum River 2nd <br />addition on Wednesday, April 15th. Staff clarified for Mr. Rauen which neighborhood streets <br />were to receive the bituminous overlay and which were to receive a seal coat under IP 09~09. Mr. <br />Rauen also expressed concern over the damage inflicted on neighborhood streets from the <br />building activity associated with the neighboring Estates of Silver Oaks subdivision. Although <br />there are segments of roadways within this project which are not exhibiting pavement failures it <br />would be economically difficult to exclude these areas and address them at a later date. It is <br />staff s opinion after meeting with Mr. Rauen and reviewing the condition of the streets that a <br />repair of failed. areas should be made and that the bituminous overlay should not be delayed. This <br />pavement is currently experiencing localized failures, and there is a high risk that such failures <br />will continue or even accelerate resulting in more expensive repair work in the future by <br />delaying the proposed work. <br /> <br />Staff met with Mr. Ross Chambers of the Hunters Hills neighborhood on Wednesday, AprillSth <br />and reviewed the condition of the streets in this subdivision. Street conditions in the subdivision <br />are consistent with what would be expected of roads constructed in 1987 (22 years old). It is <br />staffs opinion that a bitumin.ous overlay is the proper maintenance operation for a road in this <br />condition. However, at the present time there are no significant pavement failures. This roadway <br />work could be deferred if Council should choose to do so with a minimal risk of pavement <br />failures occurring in the near term. <br /> <br />Finally, at the public hearing both Mr. Rauen and Mr. Chambers suggested that the current <br />economic crisis should be taken into account and that the Council consider the possibility of <br />deferring these projects until property owners can better afford the assessments associated with <br />them. This concern has been expressed elsewhere around the metropolitan area this year (there <br />was a recent Sunday Star Tribune article in March).
