<br />WHEREAS, the City 'has the right to acquire title and possession of the Property <br />Interests prior to the filing of an award by the Court appointed commissioners, pursuant to Minn. <br />Stat. ~117.001 and~117.042; and <br /> <br />WHEREAS, the City finds and declares that it is in the public interest to acquire title to <br />and possession of the Property Interests prior to the filing of an award by the Court Appointed <br />Commissioners; and <br /> <br />WHEREAS, the property owner of the Property Interests and the Anoka County PIN for <br />the said Property Interests have been identified by the City as follows: <br /> <br /> <br />22-32-25-34-0012, 22-32-25-34-0013, <br />22-32-25-34-0014, 22-32-25-34-0015, <br />22-32-25-34-0016, 22-32-25-34-0024, <br />and 22-32-25-42-0002 <br /> <br />State of Minnesota, a sovereign <br />body, by its Commissioner of the <br />Pollution Control Agency <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br /> <br />1. That in order to carry out the purposes and objectives described above it is necessary to <br />acquire the Property Interests. <br /> <br />2. The acquisition of the Property Interests by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br /> <br />3. The City deems it necessary for the reasons set forth above to proceed without delay <br />under Minn. Stat. ~ 11 7.042 to pay to the owners or into court a sum of money to serve as <br />compensation to the owner of the Property Interests, which amount shall be equal to <br />Petitioner's approved appraisal of value as determined by the City. <br /> <br />4. That the City Administrator is hereby directed to acquire the Property Interests as <br />described above in accordance with Minnesota Statutes. The City Administrator is <br />authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />5. That if the Property Interests cannot be acquired by direct negotiation, they shall be <br />acquired by eminent domain. <br /> <br />6. That the City Council hereby authorizes acquisition of the Property Interests by eminent <br />domain and to take title and possession of that land prior to filing of an award by the <br />Court Appointed Commissioners pursuant to Minn. Stat. ~ 117.011 and ~ 117.042. <br /> <br />7. That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br />
