<br />CASE # / <br /> <br />RECEIVE PETITION REJECTING IMPROVEMENT PROJECT #09-11 BITUMINOUS <br />OVERLAY OF A PORTION OF BARTHELS RUM ACRES 2ND ADDITION <br />By: Steven Jankowski, Assistant City Engineer <br /> <br />Background: <br /> <br />At the Tuesday, April 21 Public Works Committee meeting, staff received a petition with sixteen <br />signatures rejecting Improvement Project 09-11, a bituminous overlay of streets with in the <br />above subdivision which previously had not received an overlay. The attached petition has been <br />reviewed and contains one signature of a property not within the project. In addition, two .other <br />signatures do not appear to match the names of the property owner listed with Anoka County. <br />Nevertheless, eleven valid signatures are needed for a petition sufficient to terminate the project <br />under Section 8.4.4 of the City Charter, "Petition against Coun~il Initiated Improvements". <br /> <br />This project was discussed by the Public Works Committee and staff was directed to send a letter <br />to all of the property owners within this project advising them about the City's policy pertaining <br />to street maintenance projects. This policy states that the City will not participate financially in a <br />more costly street improvement if a scheduled maintenance is rejected.
