<br />Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for it~ <br /> <br />RESOLUTION #09-04-XXX <br /> <br />RESOLUTION REQUESTING A VARIANCE FROM STANDARDS FOR <br />STATE AID OPERATIONS, 167TH AVENUE NW RECONSTRUCTION, <br />STATE AID PROJECT 199-102-006 <br /> <br />WHEREAS, the City of Ramsey wishes to reconstruct 16ih Avenue NW from 2965' <br />west ofCSAH 5 to CSAH 5; and <br /> <br />WHEREAS, adverse right-of-way and environmental impacts limit the minimum design <br />speed of the curves between stations 2+47.46 to 6+85.03 to 25 miles per hour in lieu of the 30 <br />mile pet hour minimum per 8820.9936; and <br /> <br />WHEREAS, State Aid Rules provide that a political subdivision may request a variance <br />from the Rules; and <br /> <br />BE IT FURTHER RESOLVED, that the City of Ramsey hereby indemnifies, saves and hold <br />harmless the State of Minnesota and its agents and employees of and from claims, demands, <br />actions, or causes of action arising out of or by reason of the 167th Avenue NW Reconstruction <br />project in accordance with Minnesota Rules 8820.9936 and further agrees to defend attheir sole <br />cost and expense any action or proceeding commenced. for the purpose of asserting any claim <br />arising as a result of the granting this variance. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That a variance be requested from Minnesota Rules for State Aid Operations to permit the <br />reconstruction of 167th Avenue NW, between stations 2+47.46 and 6+85.03, with a minimum <br />.design speed of25 miles per hour. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember _ <br />and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />RESOLUTION #09-04-XXX <br />Page 1 of2 <br /> <br />-201- <br />
