Councilmember Dehen suggested that the Council could give a short period of time <br />for an OST process, to have the ability to deal with some of this so there isn't exposure. Mayor <br />Ramsey stated that he thinks it would take at least 3 months for someone to purchase a property <br />and get a PUD on their property. Councilmember Jeffrey stated that he supports the Planning <br />Commission recommendation and is also concerned about possible exposure. City <br />Administrator Ulrich stated that to address the potential exposure, the City could enact a <br />moratorium or adopt an effective day far enough in the future so there is a window of <br />opportunity for the review period or the Council could build in a date of June 1, 2009, for <br />example, to adopt a new ordinance. Councilmember Look stated that he finds it intriguing that <br />the State and Federal government has no Wetland Buffer requirements. Councilmember Elvig <br />reviewed what had happened with the Tree Preservation ordinance and when people heard it was <br />coming, went and stripped their property of all trees. He stated that something similar happening <br />is his fear. Mayor Ramsey read aloud some questions that he would like to be answered as the <br />ordinance is amended. Councilmember McGlone stated that he questions the need for a buffer at <br />all. He stated that he supports a repeal and doesn't think there will be any exposure and noted <br />that no State or Federal agency have weighed in to tell us that we need this. Mayor Ramsey <br />asked that some pictures be shown that he recently took on Trott Brook trail that he feels <br />encroached on the Wetland Buffer Ordinance. Environmental Coordinator Anderson noted that <br />this plat came before the Wetland Buffer Ordinance was passed in 2005 and the City didn't own <br />the land. Mayor Ramsey stated that he thought this was built in 2007. Councilmember Wise <br />stated that he will not vote to repeal this ordinance, but would like a limited time for <br />collaboration and if no real progress is made then it can be brought back for repeal. <br /> <br />Councilmember Elvig called the question. <br /> <br />Voting Yes: Mayor Ramsey, Councilmembers Elvig, Dehen, Jeffrey, Look, McGlone and Wise. <br />Voting No: None. <br /> <br />Motion carried.
