Public Hearing <br />PROPOSED AMENDMENTS TO PERSONAL USE HELIPORTS TO ALLOW IN THE <br />TOWN CENTER SUB-DISTRICTS 1,2 & 3; arid PROPOSED AMENDMENTS TO <br />CONDITIONAL USE STANDARDS IN THE APPROPRIATE DISTRICTS <br />By: Amber G.Miller, Community Development Director <br /> <br />Background: <br /> <br />A local business requested authorization to have a weekend event that would include helicopter tours. <br />. According to 9.16 Personal Use Heliports, it appears helicopter rides would only be allowed under a <br />conditional use permit. Staff requested Council discuss this request and consider authorizing staff to , <br />issue an admiIiistrative special events permit to allow for the helicopter tours. Additionally, the City may <br />also wish to consider amending the City Code allowing helicopter use by special events permit ve:rsus a <br />conditional use permit. At the March 31, 2009 City Council Work Session this item was discussed and <br />staff was. instructed to bring it forward for public hearing to the Planning Commission at the next possible <br />meeting to address this issue and others which arose as part of the discussion. <br /> <br />Notification <br /> <br />The PublicHearing to consider amendments to Chapter 9.16 (personal Use Heliports) and amendments to <br />Conditional Use Standards in R-l Residential, R..2 ResidentiatR-3 Residential, B-1 Business, B-2 <br />Business, E-l Employment, E:..2 Employment Districts and Town Center Sub-Districts 1,2 & 3 <br />was properly advertised in the official City newspaper. ' <br /> <br />Observations: <br /> <br />Effective October 25, 2004, the Zoning Code was amended to include section 9.16 Personal Use <br />Heliports. At the time this section was added to the code, the Town Center zoning districts did not exist. <br />During Council discussion it was suggested that at some point we, may have businesse~ or medical <br />facilities in Town Center that may wish to take advantage of a heliport. However, because of the density <br />of the residential areas in Town Center, it would not be recommended for the residential districts. This in <br />addition to the special use permit were the only recol1Wlended changes to 9.16. <br /> <br />Additionally, the specific districts were never amended to include Personal Use Heliports as a Conditional <br />Use even though that is the process through which an applicant must go to obtain a permit. Each district <br />in which Personal Use Heliport would be allowed has also been amended to include it as a Conditional <br />Use. <br /> <br />Funding Source: <br /> <br />All costs associated with processing the City Code amendments are handled through normal staff duties. <br /> <br />Recommendation: <br /> <br />Staff recommends adoption of Ordinance #09-_ am~nding 9.16.03 (d) and 9.16.04 (b) and 920 to <br />include Personal Use Heliports as a Conditional Use as stated iI19.16 and listed above. <br /> <br />15 <br />
