Mayor Ramsey introduced the following resolution and moved for its adoption: RESOLUTION #09-04-089 RESOLUTION REQUESTING A VARIANCE FROM STANDARDS FOR STATE AID OPERATIONS, 167TH A VENUE NW RECONSTRUCTION, STATE AID PROJECT 199-102-006 WHEREAS, the City of Ramsey wishes to reconstruct 16ih Avenue NW from 2965' west ofCSAH 5 to CSAH 5; and WHEREAS, adverse right-of-way and environmental impacts limit the minimum design speed of the curves between stations 2+47.46 to 6+85.03 to 25 miles per hour in lieu of the 30 mile per hour minimum per 8820.9936; and WHEREAS, State Aid Rules provide that a political subdivision may request a variance from the Rules; and BE IT FURTHER RESOLVED, that the City of Ramsey hereby indemnifies, saves and hold harmless the State of Minnesota and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the 167th Avenue NW Reconstruction project in accordance with Minnesota Rules 8820.9936 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That a variance be requested from Minnesota Rules for State Aid Operations to permit the reconstruction of 16ih Avenue NW, between stations 2+47.46 and 6+85.03, with a minimum design speed of 25 miles per hour. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Elvig vote being taken thereon, the following voted in favor thereof: Mayor Ramsey Councilmember Elvig Councilmember Dehen Councilmember Jeffrey Councilmember Look Councilmember McGlone Councilmember Wise and the following voted against the same: none RESOLUTION #09-04-089 Page 1 of2
