<br />Councilmember Deluca introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION 187-265 <br />RESOLUTION DETERMINING THE SUFFICIENCY OF A PETITION FOR REFERENDUM <br /> <br />WHEREAS, the City Council of Ramsey, Minnesota, on October 13, 1987 <br />adopted Resolution #87-245 which adopted Gateway North Industrial Airport <br />Zoning Ordinance #87-7; and <br /> <br />WHEREAS, the Gateway North Industrial Airport Zoning Ordinance #87-7 <br />was published in the Anoka County Union (the City's official newspaper) on <br />Friday, October 16, 1987; and <br /> <br />WHEREAS, according to City Charter Section 3.09, all non-emergency <br />ordinances shall take effect 30 days after publication; and <br /> <br />WHEREAS, according to City Charter Section 5.07, if a petition <br />requesting that an ordinance be subjected to referendum is found to be <br />sufficient, then the ordinance shall be prevented from going into operation <br />and the subject matter of the petition shall be placed on the ballot at the <br />next election or within 120 days, whichever comes first; and <br /> <br />WHEREAS, a petition asking that Ordinance #87-7 be subjected to <br />a referendum was fil ed in the offi ce of the City Admi ni st ra tor on November <br />12, 1987; and <br /> <br />WHEREAS" the Ci ty Admi ni strator shall report to the City Council <br />within ten days of receipt of a petition calling for a referendum on the <br />sufficiency of such a petition; and <br /> <br />WHEREAS, the required number of signatures of registered voters <br />is ten percent of the total number of regi stered voters at the time of the <br />last City-wide election; and <br /> <br />WHEREAS, the last City-wide election was November 4, 1986 in which <br />5,476 persons were registered to vote, thereby requiring that to be sufficient, <br />a petition for referendum must have 548 signatures of registered voters; and <br /> <br />WHEREAS, a petition for referendum must adhere to the general <br />provisions found in Chapter 5 of the City Charter. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the City Council finds the following insufficiencies and <br />irregularities in a petition submitted to the City Administrator on November <br />12, 1987 for the purpose of submitting Ordinance #87-7 to a referendum: <br /> <br />a) The petition contains 407 signatures of registered voters <br />which is insufficient by 141 signatures; <br /> <br />b) The petition contains 132 signatures of persons whose address <br />is in Ramsey but are not registered to vote; <br /> <br />c) The petition contains 5 signatures of persons purporting to <br />be two people (e.g., Mr. and Mrs.)~ <br /> <br />Page 1 of 2 <br />
