CASE # <br />REQUEST TO AMEND THE INTERIM USE PERMIT FOR FREEDOM CHRISTIAN CENTER <br />INTERNATIONAL FOR THE OPERATION OF A CHURCH IN THE H-1 HIGHWAY 10 <br />BUSINESS DISTRICT; <br />By: Amber G. Miller, Community Development Director <br />Background: <br />Tlxe City approved the Interim. Use Permit from the Freedom Christian Center International (FOCI) was <br />to allow for the operation of temporary church facility in an area zoned H-1 Highway 10 Business <br />District. The temporary assembly facility will be in amulti-tenant building located at 6937 Hwy 10, Suite <br />160 (B& B Building). The Applicant would like to amend the Interim Use Permit to amend the approved <br />parking plan which City Council approved on April 14, 2009: <br />Notification: <br />State Statute requires notification to properties within 350 feet of the boundaries of the subject properly: <br />Observations: <br />The Applicant is proposing to utilize 5,500 square feet of the building located at 6937 Hwy 10 to have an <br />assembly area as well as offices, classrooms, lunchroom and bathrooms. The Applicant will begin <br />actively looking for a property in Ramsey on which to construct a permanent facility once they begin to <br />approach capacity in this facility. <br />The H-1 Highway 10 Business Zoning District does not expressly permit churches or other places of <br />assembly. The H-1 Highway 10 Business Zoning District does allow for offices as a permitted use. The <br />Council approved athree-year Interim Use Permit with a six month extension provided they have broken <br />ground on a new facility. The ICTP would allow for.the. operation of a church in the H-1 Zoning District. <br />The Council approved the Permit with the following conditions: <br />~l. Remaining parking area should be lined to reflect the 91 stalls they are required to provide. <br />2. Across access easement should be required with adjacent property owner for overflow <br />parking. <br />The change in use from retail to place of assembly necessitates additional parking requirements, <br />increasing required parking from 91 to 114. After speaking with the adjacent property owner, the <br />Applicant felt a cross access easement would be difficult for them to work through. The Applicant and <br />the property owner explored the option of providing more parking on the existing Ramsey Square lot. <br />According to the proposed layout, Ramsey Square would be able to accommodate a total of 110 parking <br />stalls on site while maintaining all appropriate drive aisles. This would leave them 4 stalls short of the <br />code requirement of 114 parking stalls. This represents a much smaller threshold than previously seen, <br />therefore, staff is generally acceptable to the terms. Previously the Applicant was short 23 parking stalls. <br />The majority of activity contemplated by the Applicant and interested tenant will occur on Sunday <br />mornings (one service from 10:00am to Noon), with attendance estimated to be about 75 people to start <br />and growing to 150 people.
