<br />Motion by Chairperson Nixt, seconded by Commissioner Levine, to recommend the City Council <br />not adopt the ordinance to repeal the wetland buffer ordinance and in lieu thereof recommends <br />the City Council direct the establishment of a collaborative process to involve the citizens of the <br />City, selected members of boards and commissions as they deem appropriate to further review <br />the wetland buffer ordinance and determine ways in which the wetland buffer ordinance may be <br />modified so that it doesn't fail in its essential purpose, but enhances flexibility to land owners <br />and the city to use the wetland buffer ordinance as a land management tool. <br /> <br />Motion Carried. V oting Yes: Chairperson Nixt, Commissioners Levine, Cleveland, Hunt, and <br />Van Scoy. Voting No: None. Absent: Commissioners Brauer and Rogers. <br /> <br />Case #4: <br /> <br />Request for Sketch Plan Review of Rivers Bend 5th Addition <br /> <br />Associate Planner Gladhill presented the staff report. <br /> <br />Commissioner Van Scoy, assumes the bluff height will not be modified. <br /> <br />Associate Planner Gladhill stated that would be the assumption. It has been forwarded on to the <br />DNR and they suggest that the land be rezoned as Planned Unit Development. He stated Mr. <br />Foster is aware of there not being much buildable area on this parcel and when a site plan is <br />brought forward it will have to stay within the constraints of City Code. <br /> <br />There are no new accesses being proposed. Access will be onto Xkimo Street when site plan <br />comes forward. The flood plane will go through a letter of map amendment when the site plan <br />comes forward, <br /> <br />This is a minor plat so there is not a public hearing. <br /> <br />Associate Planner Gladhill stated the purchase agreement was signed in 2006. The City is going <br />forward with the purchase because of Highway 47 upgrades and access would have to be <br />purchased at a later date. The purchase agreement did not require any certain type or rental <br />building. <br /> <br />Associate Planner Gladhill explained that if this were zoned Planned Unit Development rather <br />than R-3 Residential we could negotiate some terms for the development, such as protecting <br />open areas and asking for variations in parking requirements. We can not require that of Mr. <br />Foster, the purchaser of the plat, just suggest. I . <br /> <br />Associate Planner Gladhill state that Mr. Foster has related to the City that he wquld like to <br />construct a senior living complex.
