<br />CASE # I <br /> <br />Public Hearing <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW FOR <br />MOTOR VEHICLE SALES IN THE E-l DISTRICT: <br />CASE OF DIAMOND AUTO, INC. <br />By: Amber G. Miller, Community Development Director <br /> <br />Background: <br /> <br />Diamond Auto, Inc. is seeking to relocate their operations into the building located at 6100 <br />Highway 10 NW. The site is zoned E-l Employment, which requires a Conditional Use Permit to <br />conduct motor vehicle sales with outdoor sale or display areas. <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />Diamond Auto is seeking to locate their auto detailing and sale of used automobiles, motorcycles <br />and trucks to the building at 6100 Highway 10 NW on a portion of the site owned by Lano <br />Equipment. This building was restaurant for a brief period and was Lano's Toolbox for <br />approximately a year and has stood vacant now for several years. <br /> <br />The entire site is paved. Diamond Auto proposes to display vehicles along the front of the site <br />and along the fence; customer parking would be in front of the building and employee parking <br />would be in the rear of the building. The Applicant would be required to provide and line 15 <br />parking stalls on the site. <br /> <br />The E-l District states that open or outdoor service, sale, display and rental as a principal use <br />may be allowed as a conditional use if the following criteria are met: <br /> <br />1. The use does not take up parking space or loading area as required for conformity to <br />Chapter 9 <br />2. Sales area is surfaced with asphalt or concrete material to control dust <br />3. The provisions of Chapter 9.03.04 SubdAg are considered and satisfactorily met. <br />. I <br />While the proposed use is not industrial in nature, there is a mix of manufacturing, inqustrial and <br />retail uses currently surrounding the site. There is sufficient off-street parking and loading on the <br />site, given the significant pavement on the entire site. <br /> <br />Recommendation: <br /> <br />Staff is recommending approval of the CUP request, contingent upon the following: <br /> <br />1. Applicant would be required to line requir~d parking stalls (15). <br /> <br />1 <br />
