<br />Attachment C <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM DIAMOND AUTO INC., TO ALLOW MOTOR VEHICHLE SALES <br />AND DETAILING WITH OUTDOOR DISPLAY AND SALES AREA AT THE <br />PROPERTY LOCATED AT 6100 HIGHWAY 10 NW. <br /> <br />WHEREAS, Diamond Auto Inc., hereinafter referred to as the "Applicant," has properly <br />applied for a Conditional Use Permit to conduct indoor vehicle repair generally known as 6100 <br />Highway 10 NW and legally described as follows: <br /> <br />Lot 3, Block 1, Anoka Independent Grain and Feed, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY TillS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to SeCtion 9.03.05 of the Ramsey City Code on May 21, 2009, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />2. That the Subject Property is zoned E-l Employment. Properties surrounding zoned E-l to <br />the West, South and East and H-l to the North across Highway 10. <br /> <br />3. That the Subject Property is approximately .76 acres in size. <br /> <br />4. That City Code restricts auto detailing and motor vehicle sales with outdoor sale or display <br />areas, and requires a conditional use permit within the E-l District. <br /> <br />5. That the surrounding properties are a mixture of manufacturing, retail, and auto-related uses. <br /> <br />. 6. That the proposed use will/will not be unduly dangerous or otherwise detrimental to persons <br />residing or working jn the vicinity of the use or to the public welfare. <br /> <br />7. That the proposed use will/will not substantially adversely impair the use, enjoyment, or <br />market value of any surrounding property. <br /> <br />8. That the proposed use will/will not be hazardous or disturbing to existing neighboring uses. <br /> <br />9. That the proposed use wilVwill not be served adequately by public facilities and S~rvices such <br />as highways and streets. <br /> <br />5 <br />
