<br />Councilmember Look introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-04-076 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0841 RELATING TO A <br />REQUEST TO ALLOW FOR THE OPERATION OF A CHURCH IN THE H-l <br />HIGHWAY 10 BUSINESS DISTRICT <br /> <br />WHEREAS, the Freedom Christian Center International, hereinafter referred to as <br />"Applicant", has properly applied to the City of Ramsey (the "City") for an interim use permit to <br />operate a Church in the H-l Highway 10 Business District on the property located at 6937 <br />Highway 10 legally described as follows: <br /> <br />That part of Lot 4 Auditors Subdivison No. 31 lying southeasterly of the following <br />described line, beginning at a point on the southerly line of said Lot 520 feet <br />northwesterly of Southeast Comer thereof, thence deflecting to right 88 degrees 338 <br />feet plus or minus to northerly line of said lot and said line there terminate, except <br />road subject to easement of record, Anoka County, Minnesota. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on April 2, 2009, and that the public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated by <br />reference. <br /> <br />2. That the Subject Property is zoned H-l Highway 10 Business District; the adjacent parcels to <br />the west and east are zoned H-l Highway 10 Business District, the property to north is E-2 <br />Employment and is bounded by the Burlington Northern Santa Fe Railroad and the property <br />to the south is on the south side of Hwy 10 and is MU-PUD Mixed Use Planned Unit <br />Development. <br /> <br />3. That the H -1 Highway 10 Business District does not allow for churches as a permitted use. <br /> <br />4. That the Applicant is proposing to utilize 5,500 square feet of the building located at 6937 <br />Highway 10, Suite 160 for the purpose of a temporary Church facility. <br /> <br />5. That the Applicant is requesting that the Interim Use Permit be granted for at least three <br />years. <br /> <br />6. That Section 9.03.04A of City Code allows for an Interim Use Permit to be granted for a <br />maximum of five years, unless otherwise extended by Council <br /> <br />7. That the proposed use will not adversely impact traffic in the area. <br /> <br />8. That the proposed use will not be dangerous or detrimental to persons residing or working in <br />the vicinity of the use or to the public welfare. <br />
