Councilmember introduced the following resolution and moved for its adoption: C RESOLUTION #09- 05 -XXX RESOLUTION DIRECTING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR IMPROVEMENT PROJECT 08 -33 (UTE STREET IMPROVEMENTS) WHEREAS, pursuant to a motion of the Ramsey City Council, adopted on May 27, 2008 in response to a petition, a feasibility report for street improvements to Ute Street north of 179 Lane has been received, having been prepared by Steve Jankowski, Assistant City Engineer; and, WHEREAS, the Ramsey City Council adopted a resolution on March 10, 2009, fixing a date for a Council public hearing on the proposed improvement; and' WHEREAS, ten days: mailed notice and two weeks' published notice of the hearing was given, and the hearing was held on April 14 ,2009, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, the time available for the receipt of a petition opposing the project has expired; and WHEREAS, Section 8.4.1 of the City Charter states that the project may not be ordered for 60 days from the close of the public hearing. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA. COUNTY, STATE OF MINNESOTA, as follows: 1) That the improvement is necessary, cost- effective, and feasible as detailed in the feasibility study report. 2) That the City Engineer is hereby designated as the engineer for this improvement. 3) That the engineer shall prepare plans and specifications for the making of such improvement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: where upon said resolution was declared duly passed and adopted by the Ramsey City Council this the 26th day of May 2009.
