I am responding to your April 30, 2009 letter <br />regarding the above. The City as Lessor denies that it has in anyway breached any of the <br />covenants or obligations of the Lease Agreement between the parties dated March 28, 2008. <br /> <br />The City's storm sewer system is a utility adopted pursuant to the authority of Minn. Stat. <br />~444.075 and adopted by the City as Section 4.80 of the City Code titled "Storm Drainage <br />Utility". Since enacting said Section 4.80, the City has charged users for the storm sewer system <br />yia the Connexus Electric utility billing system. In 2008 the City changed billing providers and <br />no longer bills its municipal utilities through Connexus, but does bill through an alternate billing <br />provider. <br /> <br />The Lease Agreement provides that the Tenant is to pay for utilities and thus the City of <br />Ramsey's utility billing to the Tenant for the storm system is permitted. <br /> <br />Notwithstanding the above, in an attempt to amicably resolve this issue, City staff is willing to <br />recommend mediation of the issue to the City Council if your client is willing to participate. <br /> <br />I look forward to your response regarding the mediation suggestion. <br /> <br />Very truly yours, <br /> <br />~~;~ <br /> <br />Ramsey City Attorney <br /> <br />WKG/gb <br />cc: Kurt Ulrich, Ramsey City Administrator <br />Brian Olson, Ramsey Director of Public Works <br />
