<br />4f~ <br /> <br />CITY COUNCIL WORK SESSION <br /> <br /> <br />Topic Report: Regulation of Motor Vehicle Sales <br /> <br />By: Amber G. Miller, Community Development Director <br /> <br />Background: <br />In discussions regarding RALF prioritization and ongoing acquisitions for RALF, concems were <br />brought up regarding the number of auto sales along the Highway 10 corridor and the aesthetics <br />of them as an entrance to the community. Staff has been asked to bring forward information <br />regarding the possibility of a moratorium on allowing new auto sales locations within the Highway <br />10 corridor. <br /> <br />Observations: <br /> <br />Under the current code, motor vehicle sales are a use by right under B-2 Highway Business <br />District and H-1 Highway Business District. Under B-1 it is not a permitted or conditional use; it <br />could be allowed as a conditional use under B-3 but it would have to be enclosed with fencing or <br />walls; and it would be allowed as a conditional use under E-1 and E-2 with provisions. If Council <br />would like increase the restrictions regarding the location of motor vehicle sales within the <br />community, we could change the zoning districts to make it a conditional use under all zoning <br />districts. This would require Planning Commission and City Council to review motor vehicle sales <br />along the existing Highway 10 corridor if any of those uses cease to exist for a period of year, the <br />new tenant would have to . get a conditional use. This would be one option for the City Council to <br />consider. <br /> <br />Currently the City requires a license for vehicle repair or sales. This requires renewal on an <br />annual basis for $175.00; a dealer's license from the State for those that also sale vehicles; and <br />liability insurance. According to our current records we have 23 city licenses, three of which are <br />just for repair of motor vehicles. An additional option for the Council to consider would be to <br />restrict the number of licenses they would issue for motor vehicle sales. <br /> <br />In speaking with the State, they would recommend that we add restrictions to our code that <br />would restrict or prohibit "owner to owner" sale lots. This would be a lot that would require no <br />State sales license, but the owner would allow people to rent space to sell their vehicles. If we <br />allow these type of lots (nothing in current code would prohibit them) we should add some <br />general provisions: <br />1. Require public restrooms <br />
