<br />Councilmember Look asked if the zoning could be changed to prohibit more auto sales <br />lots from starting up but allowing the current ones to stay. <br /> <br />Councilmember Dehen stated he did not like the idea of telling the private sector what <br />they can do or not but he just wanted to make sure our standards are high enough so the <br />junk will not come in. He did not want to be in the business of telling these people what <br />they can afford or not. Here are the rules and you have to live by them. There are certain <br />businesses that cannot be viable in certain areas. <br /> <br />Councilmember Look felt that the problem is we have a disproportionate amount of used <br />car lots. . <br /> <br />Mayor Ramsey stated that if someone wants a car lot, the property has to comply with all <br />of Code - that could limit the amount of car lots. <br /> <br />City Administrator Ulrich stated that in another City he worked in, every used car lot <br />required a conditional use permit. We did have a lot of issues of them parking where <br />they were not supposed to - so we revoked the CUP. You have a lot more control as a <br />City if it is a conditional use process. <br /> <br />Councilmember Dehen wondered if that was the best way for the City to protect itself to <br />which Mr. Ulrich replied he believed it is. <br /> <br />Mayor Ramsey stated he is not in favor of rezoning to prohibit car lots. <br /> <br />Ms. Miller stated you would not have to rezone - it would be listed as a conditional use <br />instead of a permitted use and there would be more conditions to follow. <br /> <br />Councilmember Jeffrey stated he liked the idea of it requiring a CUP - for maybe <br />anything that has tires on the ground - however, he wondered about car repair businesses. <br />He asked what it would take to revoke a CUP - and will if it would cost a lot of money to <br />do so. <br /> <br />City Attorney Goodrich stated that it would take a public hearing and a positive showing <br />of the'violation - it could take some time. <br /> <br />Councilmember Dehen stated maybe as part of the issuance of the CUP we state we have <br />zero tolerance for violations. <br /> <br />Ms. Miller stated that if there are any violations, usually if the business is making a good <br />faith effort to get it taken care of - staff and the business owner work together. The judge <br />usually looks to see if the City made a good faith effort before going through the extreme <br />of revoking a permit. We have 30 days listed in our Code for a business to come into <br />compliance. <br /> <br />Councilmember Jeffrey stated maybe it should say "up to 30 days". <br /> <br />City Council Work Session - June 2, 2009 <br />Page 7 of 13 <br />
