<br />;L <br /> <br /> <br />CI.TY COUNCIL WORK SESSION <br />Topic Report: Review of Nuisance <br />Abatement Services Proposals <br />By: Jim Way, Chief of Police <br /> <br /> <br />Background: <br />The City issued an RFP for Nuisance Abatement Services on May 29, 2009. Five <br />proposals were received by the City by the June 19,2009 deadline. Staffwould like to <br />review the proposals with Council. <br /> <br />Staff would like to note that one of the proposals received was submitted by a sitting <br />council member. City attorney Goodrich has proved the procedure for a council member <br />to contract with the City. <br /> <br />Minn. Stat Sec. 471.87 provides thatno public officer who is authorized to make take <br />part in th~ authorizing of various public contracts may have a personal financial interest <br />in said contracts unless an exception is provided for in the statutes. Penalty for violation <br />is gross misdemeanor. <br /> <br />One exception is permitted by Minn Stat 471.88 Subd 5. which permits a contract with a <br />public officer when there is no competitive pid requirement AND the City Council by <br />una:nilllousvote authorizes the contract. The following procedure is to be followed: <br /> <br />1. Unless in a:nelllergency, the City Council shan authorize the contract IN <br />ADVANCE ofitspetformance by adopting a "...resolutlon setting out the <br />essential facts and determining that the contract price is as low as or lower than <br />the price at which the commodity or services couId be obtained elsewhere." <br />2 Before the claim is paid, the interested public officer shall file an affidavit with <br />the City Clerk which affidavit shall provide the following information: <br />a. The name of the officer and the office held by the <br />officer: <br />b. The contract price; <br />c. The reasonable value; <br />d. The interest of the officer in the contract; and <br />e. That to the best of the officer's knCiwl~dge and <br />belief the contract price is as low as or IQwerthan <br />the price at winch the commodity ot setvicescould <br />be obtained from other sources <br />
