Kootenai County,2009 WL 987410 (Idaho 2009) <br /> <br />IDAHO (04/14/09)-James and Penny Wohrle owned a waterfront <br />parcel on a lake. The parcel had 100 feet of frontage that could only be <br />accessed via the water due to the steep and rocky terrain of the prop- <br />erty. Jerry Judd owned a similar piece of property on the same lake. The <br />Wohrles and Judd (hereinafter, collectively, the "Wohrles") both con- _ <br />structed decks on their properties without first obtaining a variance or <br />building permit from the county. They did so in order to "provide a flat <br />area for recreational use of the land." <br />Mter receiving a code violation notice from the county, the Wohrles <br />applied to the county's Board of Commissioners (the "Board") for vari- <br />ances from the county's 25-foot front setback requirement.
