Kootenai County,2009 WL 987410 (Idaho 2009)

IDAHO (04/14/09)-James and Penny Wohrle owned a waterfront
parcel on a lake. The parcel had 100 feet of frontage that could only be
accessed via the water due to the steep and rocky terrain of the prop-
erty. Jerry Judd owned a similar piece of property on the same lake. The
Wohrles and Judd (hereinafter, collectively, the "Wohrles") both con- _
structed decks on their properties without first obtaining a variance or
building permit from the county. They did so in order to "provide a flat
area for recreational use of the land."
Mter receiving a code violation notice from the county, the Wohrles
applied to the county's Board of Commissioners (the "Board") for vari-
ances from the county's 25-foot front setback requirement. They request-
ed the county allow a front setback of zeroat the property line for the
existing decks.

WEST@

610 Opperman Drive. P.O. Box_ 64526 .
