<br />Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-07-XXX <br /> <br />A RESOLUTION APPROVING CONTRACTING WITH A VENDOR OR VENDORS <br />FOR ABATEMENT SERVICES: <br /> <br />WHEREAS, the City of Ramsey has been using local vendors for abatement services that <br />include mowing and blight clean up. Abatements have increased over the past year and the <br />recent rise in home foreclosures in the City has added to the locations needing clean up. To <br />expedite the abatement process, staff sought authorization to seek proposals for contracted <br />abatement services. This would allow a contractor to be in place and able to respond to take care <br />of troubled properties. in an expedited manner. <br /> <br />WHEREAS, the City issued an RFP for Nuisance Abatement Services on May 29,2009. <br />A notice was published in the Anoka County Union on May 29,2009. The deadline for proposals <br />was June 19,2009 at 4:30 pm. Five proposals were received by the City by the June 19,2009 <br />deadline. Staff reviewed the five proposals with Council at the June 30, 2009 Work Session. <br /> <br />WHEREAS, Staff would like to note that one of the proposals received was submitted by <br />a sitting council member. City attorney Goodrich has provided the procedure for a council <br />member to contract with the City. <br /> <br />Minn. State Statute 471.87 provides that no public officer who is authorized to take part <br />in the authorizing of various public contracts may have a personal financial interest in <br />said contracts unless an exception is provided for in the statutes. Penalty for violation is <br />gross misdemeanor. <br /> <br />One exception is permitted by Minn Stat 471.88 Subd 5. which permits a contract with a <br />_public officer when there is no competitive bid requirement AND the City Council by <br />unanimous vote authorizes the contract. The following procedure is to be followed: <br /> <br />1. Unless in an emergency, the City Council shall authorize the contract IN ADVANCE <br />of its performance by adopting a ".. .resolution setting out the essential facts and <br />determining that the contract price is as low as or lower than the price at which the <br />commodity or services could be obtained elsewhere." <br />2. Before the claim is paid, the interested public officer shall file an affidavit with the <br />City Clerk which affidavit shall provide the following information: <br />a. The name of the officer and the office held by the <br />officer; <br />b. The contract price; <br />c. The reasonable value; <br />d. The interest of the officer in the contract; and <br />e. That to the best of the officer's knowledge and belief <br />the contract price is as low as or lower than the price at <br />
