CASE# 5. REQUEST FOR EXTENSION TO SUBMIT FINAL PLAT FOR Ri\MSEY TOWN CENTER 6TH ADDITION AKA GABLES TERRACE; CASE OF D.R. HORTON, INC. By: Amber G. Miller, Planning Manager Background: D.R. Horton Inc. received [mal site plan and final plat approval of Ramsey Town Center 6th Addition in May of2005. In November 2006, the City Council granted an extensIon of final plat approval until May 2008. Following that, D.R. Horton submitted a revised preliminary plat, which was approved by the City Council on July 24, 2007. A final plat and final site plan were submitted for the revised Ramsey Town Center 6th Addition in February of 2008 and the name of the revised plat was changed to Gables Terrace. The final plat and site plan were originally scheduled for a Council agenda this past March. The applicants requested a postponement of the case. In July of 2008, the Applicants requested that the Gables Terrace be granted an additional extension of final plat which the Council granted for a term of six months. The Council approved an additional extension in January of2009. Funding Source: All staff costs associated with the extension request are the responsibility of the developer. Observations: The current state of the real estate market has caused many developers to substantially delay their residential projects and in some cases completely abandon their projects. This is a project with potential to continue to move forward and staff would like to continue to facilitate that. Staff received a request for an extension of final plat in June for one year. One of the primary, issues that had been holding up the plat for Gables Terrace was the access to 146th Avenue. The road right-of-way was never dedicated and became entangled in the foreclosure process for RTC. That issue is now resolved but the housing market is somewhat questionable for them to start a new subdivision. They are requesting a one year extension. This seems to be a reasonable request as the process was put on hold for some time until the 146th Avenue ROW issue was resolved. Recommendation: City Staff recommends approval of a one year extension to July 14, 2010 for the developer to submit a final plat application.
