Each plan must identify member local units or government that have failed to adopt and <br />administer a MDNR-approved shoreland and floodplain ordinance where mandated by <br />state law. If a plan notes the existence of certain land uses that could adversely affect the <br />organization's ability to achieve its water quality goals, and these uses cannot be <br />properly managed or regulated with existing controls, the uses constitute a public <br />nuisance according to Minnesota Statutes, Section 609.74. In those cases, the plan must <br />provide for the adoption of local controls to define and abate the nuisances. For the <br />purpose of this chapter, public nuisance may include any action, failure to act, or land <br />use practice that would impair water quality if allowed to continue. <br />Any change in land use from the zoning at the time of adoption of this plan that covers 1 acre or <br />more must be approved by all municipalities in the subwatershed where the change is to occur. <br />Notification of intent to change land use and all pertinent information shall be given to the <br />representative of the affected city twenty-one (21) days before the zoning change is to take place. <br />Upon receipt, approval or rejection shall be made within 21 days. If no response is made, approval <br />will be implied. If the change is rejected within the specified time limit, an acceptable solution <br />should be attempted by all municipalities in the subwatershed.
