<br />Attachment B <br /> <br />9.20.27 <br /> <br />H-1 Highway 10 Business District <br /> <br />Subdivision 1. Intent and Official Map. <br /> <br />a. Intent. The City finds that the properties lying between Highway 10 and <br />Burlington Railroad tracks are integral to the future improvement of the U.S. <br />Highway 10 transportation system. These properties are therefore in a state of <br />transition. The intent of the H-1 Highway 10 Business District'is to allow for <br />uses that minimize traffic, vehicular access, and facilitate orderly transition of <br />the corridor while allowing the property owners the ability to utilize their <br />property for economic benefit until such time as the U.S. Highway 10 <br />transportation system improvements are initiated. <br /> <br />b. Official Map. In order to preserve the land that is needed for the U.S. <br />Highway 10 Transportation System, the City has identified said corridor on its <br />Official Map. All land use applications in the H-l Highway 10 Business <br />District will be subject to the requirements of the Official Map section of the <br />City Code. . <br /> <br />c. Non-Conforming Structures, Buildings and Uses. Structures, buildings and <br />uses in existence upon the effective date of this ordinance (June 10, 2004) <br />shall be considered legal non-conforming and shall be regulated by Section <br />9.03.14 (Non-Conforming Structures and Uses). Any existing buildings that - <br />exceed the 35% maximum structure size restriction shall not be allowed to <br />expand or intensify through the issuance of variances, conditional use permits, <br />or interim use permits. <br /> <br /> <br />Subd. 2. Permitted Uses (Subject to Standards established in Subd. 4 and <br />Performance Standards established in g9.10) <br /> <br />a. Indoor/outdoor commercial recreational uses. <br /> <br />b. Government!,!l and public utility buildings and structures. <br /> <br />. , <br />c. Motor '.'chiclc, implement, and rocreation equipmentsules and service. <br /> <br />~Animal Clinics. <br /> <br />e:fhAdult uses-principal and adult uses-accessory. <br /> <br />f.LEnclosed retail sales and rental activity. <br /> <br />g,-L Offices, personal and professional services. <br /> <br />fr..g,.Commercial car washes (drive through and mechanical). <br /> <br />{J <br /> <br />80 <br />
