<br />3. That the Subject Property is surrounded by properties also zoned R~1 Rural Preserve. <br /> <br />4. That RaI11sey City Code Section 9.11.02 Subd. 4 does not permit the construction of <br />accessory buildings nearer the front property line than the principal building on lots less <br />than two (2) acres in size. <br /> <br />5. That Ramsey City Code Section 9.20.11 requires a setback of 60 feet from centerline of <br />County Roads plus the local applicable setback of 40 feet for a total of 100 foot setback <br />from the centerline ofNowthen Boulevard (CSAH 5). <br /> <br />6. That the Applicant is proposing to construct an Accessory Structure 93 feet from centerline <br />ofNowthen Boulevard CCSAR 5), seven (7) deficient of the required setback. <br /> <br />7. That the Application was forwarded to Anoka County for comment. No comment had been <br />received at the time of the Board of Adjustment Meeting on August 6, 2009. <br /> <br />8. That the Applicant is proposing to construct a 35' x 28' accessory structure on the Subject <br />Property. <br /> <br />9. That the new accessory structure is to be used to house a commercial vehicle used in a <br />Home Occupation. <br /> <br />10.. That the total square footage of accessory buildings on the Subject Property, including the <br />proposed building, will comply with the maximum allowable square footage in City Code. <br /> <br />11. That the proposed accessory building will comply with the height regulations outlined in <br />City Code, with the exception of the sidewall height in order to match the height of the <br />existing accessory structure. <br /> <br />12. That the proposed accessory building will be well screened from adjacent properties by <br />existing trees. <br /> <br />13. That similar.variances have been granted in the R-l District in the City of Ramsey. <br /> <br />14. That the topography of the front yard and wet conditions in the rear of the yard imposes a <br />hardship on the Subject Property that is not applicable to other lots in the same district.. . <br /> <br />15. That, if granted, the variance wilVwill not impair an adequate supply of light and air to <br />adjacent property. <br /> <br />16. That, if granted, the variance will/will not have the effect of allowing a use that is <br />prohibited in the applicable zoning district. <br /> <br />17.
