<br />Attachment D <br /> <br />Board Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-08-_ <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT AN <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE, VARIANCE TO FRONT YARD SETBACK, AND <br />SIDEWALL HEIGHT RESTRICTIONS <br /> <br />WHEREAS, Russell Peterson; hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.11.02 (Accessory Structures) of the Ramsey City Code to <br />construct an accessory structure nearer the front property line than the principal structure on the <br />property generally known as 17725 NowthenBlvd NW and legally described as follows: . <br /> <br />That part of the Southeast Quarter of the Northwest Quarter of Section 3, Township 32, <br />Range 25, Anoka County, Minnesota described as follows: <br /> <br />Commencing at the intersection of south line of said Quarter. Quarter and center line of <br />CSAH No.5, said point of intersection being 862.82 feet west of southeast comer of said <br />Quarter Quarter, thence northwesterly along said center line along a curve concave to <br />northeast having a radio us of 1800.40 feet a center angle of 8 degrees 47 minutes 276 <br />feet to point of beginning, chord to said curve bears north 40 degrees 02 minutes 05 <br />seconds west, thence continuing northwesterly along said centerline along same described <br />curve to right having a radious of 1800.40 feet with a central angle of 1 degree 03 minutes <br />32.99 feet, thence north 35 degrees 07 minutes 05 seconds west 150 feet, thence <br />. northeasterly at a right angle and to a point which is 749.56 feet west of east line of said <br />Quarter Quarter, as measured along said line thereof, thence southerly pararell with east <br />line of said Quarter Quarter to a point which is 373.3 7 feet north of south line of said <br />Quarter Quarter, as measured along east line thereof, thence west parallel with south line <br />of said Quarter Quarter to intersect with a line drawn from point of beginning on a <br />bearing of north 53 degrees 49 minutes 55 seconds east, thence south 53 degrees 49 <br />minutes 55 seconds west to point of beginning, except road subject to easement of record. <br /> <br />(Subject Property). <br /> <br />AND WHEREAS, the Board of Adjustment conducted a public hearing on September 6, <br />2006, pursuant to Section 9.03.07 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY; ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact # _, a variance to construct an accessory building nearer <br />the front property line than the principal building, with a setback of 93 feet to centerline, and <br />sidewall height to' match the existing accessory structure (the "Variance") on the Subject <br />Property is hereby granted. . <br /> <br />1 1 <br />
