<br />CASE # :;z <br /> <br />PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY <br />BUILDING NEARER THE FRONT PROPERTY LINE WITH A VARIANCE TO <br />FRONT YARD SETBACK AND SIDEWALL HEIGHT; <br />CASE O;F RUSSELL PETERSON <br />By: Tim Gladhill, Associate Planner <br /> <br />Background: <br /> <br />Section 9.11.02 ofthe Ramsey City Code states that on properties less than two (2) acres in size, <br />no accessory bHilding shall be constructed nearer the front property line than the principal <br />building. Mr. Peterson has applied for. a variance to construct an accessory building nearer the <br />front property line than,his home on the property located at 17725 Nowthen Boulevard (CSAR <br />5). In addition, the Applicant is requesting a variance to front yard setback and sidewall height. <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff sent notification to property owners within 350 feet of the <br />subject property of the request for a variance. <br /> <br />Observations: <br /> <br />. The subject property is about 1.53 acres and thus, City Code requires' any detached accessory <br />building to be constructed in the side or rear yard. The Subject Property has steep topography in <br />the front yard, necessitating the need for a Variance to sidewall height in order to match the <br />existing accessory structure. The Applicant is proposing to add on to the existing accessory <br />structure on the Subject Property. <br /> <br />The Applicant currently owns a septic pumping and repair service, which includes only storing a <br />commercial pumper on the Subject Property. This accessory structure would allow the Applicant <br />to comply with Home Occupation regulations stating that commercial vehicles must be stored <br />indoors or in the side or rear yard, on an approved surface, and screened to a degree of75% or <br />more at ground level. However, this fact shall not be considered as a factor i~ approving a <br />Variance under City Code. <br /> <br />All other terms of the Accessory Structure and R-1 Residential Ordinances shall apply. <br /> <br />Recommendation: <br /> <br />City Staff recommends approving the variance request, based on a hardship of topography. The <br />topography does not allow the Applicant to match the existing. accessory structure while <br />maintaining a 10 foot sidewall height. In addition, the topography and configuration of the lot <br />present a hardship of placing the proposed structure in the side or rear yard. <br /> <br />3 <br />
