<br />Baard Member Jeffrey intraduced the fallawing resalutian and maved far its adaptian: <br /> <br />RESOLUTION #09-04-090 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0843 RELATI;NG TO A <br />REQUEST FOR A VARIANCE TO THE PLATTING REQIDREMENTS IN CITY CODE <br />TO ALLOW A METES AND BOUNDS SUBDIVISION ' <br /> <br />WHEREAS, LAN D Praperties, hereinafter referred to. as "Applicant", has praperly <br />applied far a variance to. platting requirements established in Sectian 9.50 (Subdivisian) af the <br />Ramsey City Cade to. facilitate a metes and baunds subdivisian to. facilitate the cambinatianaf <br />two. parcels with current legal, nan-canfarming statuses. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant entered into. a Develapment Cantract an June 5, 1979 to. canstruct a <br />warehause facility (the "Warehause") in 1979 an PID 35-32-25-32-0021 (the "Parcell"). <br />Parcel 1 was zaned B-1 Cammunity Business at time af develapment. Parcel 1 is owned by <br />LAN D Properties. <br /> <br />2. That the Applicant acquired PID 35-32-25-32-0023 (the "Parcel 2") priar to. canstructing an <br />expansian (the "Expansian") af the Warehause. The Applicant entered into. a Develapment <br />Agreement with the City in July, 1983 to. canstruct the Expansian.Parce12 is also. awned by <br />LAN D Properties. <br /> <br />3. That the Warehause, tagether with the Expansian, is herein referred to. as the Structure. <br /> <br />4. That the Site Plan far the Expansian indicated that the sautherly line af Parcel I (the <br />"CammanPraperty Line") had been maved as to. allaw far apprapriate setbacks. Current <br />property recards indicate that the Camman Praperty Line has natbeen moved and is currently <br />lacated thraugh the Structure, thus creating the need far a variance to. allaw far zero. lat line <br />setback, unless the Cammon Property Line is remaved. <br /> <br />5. That Parcel I and Parcel 2 received a Zaning Amendment to. E-1 Emplayment as guided by <br />the 2001 Camprehensive Plan, thus creating Legal, Nancanfarming Uses af setbacks and lat <br />caverage. In additian, an August 12, 1985, the City amended City Cade Chapter 9 to. include <br />the Mississippi River Critical River Overlay District, which boundaries include Parcel 2, thus <br />creating additianal Legal, Nanconfarming Uses. <br /> <br />6. That City Cade daes nat permit the cambination of lats thraugh the Administrative <br />Subdivisian process if the subdivisian creates a nancanfarming use. The cambinatian af <br />Parcell and Parcel 2 represents a Noncanfarming Use because afthe items listed--in Item #5 <br />abave. <br />
