<br />WHEREAS, Section 9.50.02 Subd. 5 (a) (Final Plat), Subd. 1 of the Ramsey City Code <br />states that following approval of a preliminary plat, the applicant shall file a final plat for <br />consideration by the City Council within one year of preliminary plat approval; and <br /> <br />WHEREAS, Section 9.50.02 Subd. 5 (a) (Final Plat) of the Ramsey City Code further <br />states that subsequent to the one year deadline, the applicant may request the City Council grant <br />an extension for submission of a final plat; and <br /> <br />WHEREAS, Section 9.50.02 (Major Plat), Subd. 8 (Recording), of the Ramsey City <br />Code further states that within two years of the date of City Council approval of the final plat, the <br />final plat shall be recorded at Anoka County; thereafter the City Council may extend the <br />recording period upon written application by the subdivider; and <br /> <br />WHEREAS, on September 29, 2006 the City received a written communication from <br />Summerset Meadows LLC requesting a one-year extension for submittal of a final plat for the <br />Summerset Meadows subdivision; and <br /> <br />WHEREAS, on October 10, 2006, the City Council adopted resolution 06-10-319 that <br />granted the applicant until October 25,2007 to submit a final plat; and <br /> <br />WHEREAS, on September 20, 2007, the City received a written communication from <br />the Summerset Meadows LLC requesting an additional one-year extension for submittal of a <br />final plat for the Summerset Meadows subdivision; and <br /> <br />WHEREAS, on October 23,2007, the City adopted Resolution #07-10-292 that granted <br />the applicant until October 25, 2008 to submit a final plat; and <br /> <br />WHEREAS, the City received a written communication from Summerset Meadows LLC <br />on September 2, 2008 requesting an additional two-year extension for submittal of a final plat for <br />the Summerset Meadows subdivision based on the current challenges of the Twin Cities <br />residential market; and <br /> <br />WHEREAS, on October 14,2008, the City adopted Resolution #08-10-201 that granted <br />the Applicant until April 25, 2009 to submit a final plat; and <br /> <br />WHEREAS, the City received a written communication from Summerset Meadows LLC <br />on April 22, 2009 requesting an additional one-year extension for submittal of a final plat for the <br />Summerset Meadows subdivision based on the uncertain housing market outlook and further <br />stated that loss of entitlement to the project could jeopardize the Applicants' financing and <br />viability of the Applicants' future development; and <br /> <br />WHEREAS, a one-year extension to file for final plat approval in combination with the <br />two-year recording time frame has the potential to postpone the project to 2012 provided no <br />further extensions are granted to file for final plat approval or record the final plat; and <br /> <br />RESOLUTION #09-06-117 <br />Page 2 of 4 <br />
