<br />,. <br />.. <br /> <br />2008232.008 <br /> <br />111111111111111111111111111111111111111111111 <br />Record 10 2216675 <br /> <br />~ <br /> <br />Councilmember Look introduced the following resolution and moved for its adoption: <br />~te'B JUL 6 6 2eB~ <br /> <br />RESOLUTION #09,.06-119 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO DIAMOND AUTO INC., TO ALLOW MOTOR VEIDCHLE SALES AND <br />DETAILING WITH OUTDOOR DISPLAY AND SALES AREA IN THE E-l <br />EMPLOYMENT DISTRICT AND DECLARING TERMS OF SAME: <br /> <br />WHEREAS, Diamond Auto Inc., hereinafter referred to as the "Permittee" has properly <br />applied for a Conditional Use Permit to conduct indoor vehicle repair on the property legally <br />described as.follows: <br /> <br />Lot 3, Block 1, Anoka Independent Grain and Feed, Anoka County, Minnesota <br /> <br />("Subj ect Property") <br /> <br />WHEREAS, the Planning Commission met on May 21, 2009, conducted the <br />public hearing and recommended City Council approval/denial of the request, with <br />contingencies. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That based on Findings of Fact # 0845, a Conditional Use Permit ("Permit") to allow auto <br />detailing and conduct motor vehicle sales with outdoor sale or display area is hereby granted <br />to the Permittee. <br /> <br />2. That this Permit only allows vehicle detailing to take place within the building located on the <br />Subject Property. <br /> <br />3. That no vehicle repairs are permitted in the building or on the Subject Property. <br /> <br />4. That only vehicles awaiting detailing may be stored behind the building; storage of parts or <br />inoperable vehicles is not permitted. <br /> <br />5. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />6. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Permit. <br /> <br />7. That the City Administrator, or his/her designee, shall have the right to inspect the premises. <br />for compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br />8. That this Permit shall automatically expire ifthe use is not initiated by July 1,2010. <br />
