<br />Assistant City Engineer Himmer explained the existing water main set the alignment for this <br />request, which was paid for through the Oakwood extension of utilities and corresponds with <br />how this property would subdivide. <br /> <br />Motion by Board Member Nixt, seconded by Board Member Rogers, to adopt Resolution #09- <br />01-001 adopting Findings of Fact #0839 relating to the request for a variance to the minimum lot <br />size requirements in the R-l Rural Developing District. <br /> <br />Further Discussion <br /> <br />Board Member Cleveland asked when the proposed water tower is scheduled to be constructed. <br /> <br />Assistant City Engineer Himmer replied the feasibility report will be presented to the Council on <br />January 27 at which time staff hopes to receive authorization to proceed with preparing plans and <br />specifications. He stated construction will begin this summer and the water tower would be <br />online by.the end of2010. He further explained that the City is in negotiations right now for the <br />three parcels and staffhopes to close in February on all three parcels. <br /> <br />Board Member Nixt asked if the City has binding commitments to sell for all three parcels. <br /> <br />Assistant City Engineer Himmer replied in the affirmative, and stated the parcel being discussed <br />this evening has a purchase agreement drafted; however, it listed Oakwood as the owner rather <br />than Alvin Goebel. <br /> <br />Board Member Nixt asked if the City has the right to acquire all the property it needs to get to the <br />water tower property and to put the water tower in place. <br /> <br />Assistant City Engineer Himmer replied in the affirmative and added staff will go to the Board of <br />Appeals to get the waiver of the subdivision. <br /> <br />Board Member Nixt stated all three parcels need to come together simultaneously and asked if <br />the City can walk out of this transaction if that does not occur. <br /> <br />Community Development Director Miller replied in the affirmative. <br /> <br />Assistant City Engineer Himmer noted that staff plans to close on all the parcels on the same day. <br /> <br />Motion Carried. V oting Yes: Chairperson VanScoy, Board Members Nixt, Rogers, and <br />Cleveland. Voting No: None. Absent: Board Member Hunt. <br /> <br />Motion by Board Member Nixt, seconded by Chairperson Van Scoy, to adopt resolution #09-01- <br />002 to approve the request for a variance to the minimum lot size in the R -1 Rural Developing <br />District and terms of the variance, contingent on approval of the metes and bounds subdivision <br />request. <br /> <br />Board of Adjustment/January 8, 2009 <br />Page 6 of7 <br />
