e -a4 Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #09 -08 -XXX RESOLUTION GRANTING FINAL PLAT APPROVAL TO ROAD RIGHT OF WAY PLAT NO. I RELATED TO IMPROVEMENT PROJECT 908-33, UTE STREET IMPROVEMENTS WHEREAS, the Ramsey City Council adopted a resolution on March 10, 2009, fixing a date for a Council public hearing on Improvement Project #08-33, Ute Street Improvements north of 179"' Lane and, WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held on April 14, 2009, at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, Improvement Project #08-33 was subsequently ordered by the City Council on May 12, 2009; and, WHEREAS, the feasibility study associated with the project described the need for right of way and utility easements consistent with Right of Way Plat No. 1; WHEREAS, the acquisition of the parcels described in Right of Way No. 1 are required for the project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) - That the Ramsey City Council hereby grants final plat approval to City of Ramsey Road Right of Way Plat No. 1. 2) That the Mayor and City Administrator are hereby authorized and directed to execute the plat on behalf of the City of Ramsey and the execution of said plat by the Mayor and City Administrator is hereby ratified and confirmed. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: Where upon said resolution was declared duly passed and adopted by the Ramsey City Council this the 25th day of August 2009.
